How strong are your Terms & Conditions? Is your Contract watertight? And are you fully covered?

Ok, so the title might be a bit misleading because I actually don't believe in Terms & Conditions & Contracts. And I don't think they really cover you.

That's right - you heard me right - I think they are Corporate BS!

It's part of what attracted me to being an EOS Implementer (Implementer of the Entrepreneurial Operating System). Even though it's a global organisation with over 360 Implementers around the world & used in over 8,000 companies, we don't do contracts, agreements or terms & conditions.

In fact we go one step further & have a guarantee - we deliver one day at a time & you only pay us at the end of the day, if (and it's a big IF) you see value!

So no long term tie-ins, no agreements, no terms & conditions & you only pay if you see value. That's a bit risky isn't it?

Don't get me wrong - we expect you to make a long term mental commitment to the system - you have to be committed to it to make it work but that commitment is with yourself - not with me.

I know by now you are probably thinking that I have lost the plot. There's so much risk involved right - we need to have lots of legal documents to protect us.

I mean, what if a client doesn't pay? What if a client is deliberately wanting to take advantage? What if... There are so many what ifs!

So here's the deal.

I know, without a doubt, that people who spend a day with me learning about EOS will get value, so they will pay. But more importantly, I get to choose who I work with, so people will only choose me if they think I can add value & I will only work with people who I believe I can add value to.

Sounds like there's not much risk there?? Or am I over simplifying it... If so, I hope so, because that's what I like to do :)

So, it makes my blood boil when I see consultants, lawyers & accountants taking a simple process & making it complex, producing documents that are pages & pages long & that are 'defendable'.

People do business with people, and if you choose the people that you work with, then most of the time you will be ok.

Don't get me wrong, sometimes things do go wrong & that's why all EOS Implementers have Professional Indemnity insurance (& I've had it for my 11 years of Business Coaching), just in case something major goes wrong with the client.

However if I do spend a day with a client & they don't get value then I don't want them to pay me. And I don't want them to continue to work with me if they don't want to.

There may also be times when I don't want to work with them & that's absolutely fine too!

A while ago I worked with an organisation who insisted that we signed people up for contract for a longish period of time & you had to hold them to it. If they wanted to pull out then you had to force them to pay the full contract price. Why? Do you really want to work with someone who doesn't want to work with you anymore? Do you want to piss them off when you chase the payments for a service they haven't seen value in?

And yes, sometimes I do have agreements with partnerships in business, but they're generally a one page agreement in plain, simple English:

- Here's what I agree to do

- Here's what you agree to do

And that's it :)

I think the other thing you want to think about is your brand. How do you represent yourself? Do you have values that contradict your Terms & Conditions?

For example, do you say that you 'Help First' & then demand up front payment?

Or do you say that you are in partnership with your clients & then send them a large terms & conditions that is all about protecting yourself? If so, is that really a partnership?

I'm not saying it's for everyone but do make sure that what you present to a client is in keeping with your values.

I LOVE what I do & I know I add huge value. I want to work with people who see that value & trust me. We don't need paperwork to make that work.
